Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the PayerScape website, application, and related services (collectively, the “Service”) operated by PayerScape (“we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms.
1. Who may use the Service
The Service is intended for ABA therapy agencies, clinicians, intake staff, and other business users evaluating payer and plan information. You must be at least 18 years old and able to form a binding contract. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.
2. Accounts and access
- You are responsible for maintaining the confidentiality of your login credentials.
- Agency admins may invite team members (“seats”) subject to subscription limits and billing.
- You must provide accurate account and agency information during onboarding.
- We may suspend or terminate access for violations of these Terms or to protect the Service.
3. Subscription plans
The Service offers tiered access, including:
- Free — limited to one state, with access to payer landscape and plan browsing features as described on our pricing page
- Paid — additional features such as multi-state access, plan comparison and PDF export, saved plan management, and team seats
Paid subscriptions are billed through Stripe. Fees, renewal terms, and seat pricing are shown at checkout or in your subscription settings. Except where required by law, fees are non-refundable.
4. Acceptable use
You agree not to:
- Use the Service for unlawful purposes or in violation of applicable regulations
- Scrape, resell, or redistribute Service data or outputs except as expressly permitted
- Attempt to gain unauthorized access to accounts, systems, or data
- Interfere with or disrupt the Service or its infrastructure
- Misrepresent affiliation with PayerScape or upload malicious code
5. Payer and plan information — important disclaimers
PayerScape aggregates and presents insurance plan and benefit information from third-party data sources for research and operational planning. The Service does not provide medical, clinical, billing, coding, or legal advice.
- Benefit classifications (such as “ABA named”) are automated aids based on available documents
- Plan availability, premiums, networks, and benefits change frequently
- You must independently verify coverage, medical necessity, prior authorization, and reimbursement with each payer before treating clients or relying on any output
You assume full responsibility for decisions made using information from the Service.
6. Intellectual property
We own the Service, including software, design, branding, and compiled presentations of data. You receive a limited, non-exclusive, non-transferable license to use the Service during your subscription for internal business purposes. Third-party payer data remains subject to its respective sources and licenses.
7. Your content
You retain ownership of notes, tracking statuses, and other information you enter. You grant us a license to host, process, and display that content solely to provide the Service to you and your authorized team members.
8. Privacy
Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.
9. Third-party services
The Service integrates with third parties such as Auth0 and Stripe. Your use of those services may be subject to their separate terms and policies.
10. Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETE.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAYERSCAPE AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100) IF YOU HAVE NOT PAID FEES.
12. Indemnification
You will defend and indemnify PayerScape against claims arising from your use of the Service, your content, or your violation of these Terms, except to the extent caused by our gross negligence or willful misconduct.
13. Changes to the Service or Terms
We may modify the Service or these Terms at any time. If we make material changes, we will provide notice by posting updated Terms and updating the “Last updated” date. Continued use after changes become effective constitutes acceptance.
14. Termination
You may stop using the Service at any time. We may suspend or terminate access for breach, non-payment, or to comply with law. Upon termination, your right to use the Service ends, but sections that by nature should survive (including disclaimers, limitations of liability, and indemnity) will survive.
15. Governing law
These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law principles, except where mandatory consumer protections in your jurisdiction apply.
